WHile my knee jerk reaction is that this looks bad... 

PLEASE lets all remember that police reports only have
enough information written to make the arrest... and
that is what was reported in the BDN... same paper
that got the Hamilton incident so screwed up that it
was laughable.

the BDN is not going to report anything but the police
report and the police report will not have anything in
it except enough allegations and admissions to make an
arrest.
so we have a kid with a broken bone who stated that
Payson did it.
we have no police witnesses so we need a serious
injury AND an admission by Payson.   (the admission
was that he was there and the he contacted the kid;s
head... NOT THAT HE IS GUILTY OF AGGRAVATED ASSAULT)

the police got their admission and so they made the
arrest.
there might have been extenuating circumstances or
self defense.... neither of which even belong in a
police report, so we are not going to hear about
either one until there is a trial.... at the
arraignment, all we will hear is the injury plus the
admission.

judge if you want/must... but please understand that
you are judging based on a police report
