The school has to offer equity.  Same percentage of scholarships, but if
you have a lot more of out-of-state scholarships for men, they will cost
more.  A light weight women's crew team is a lot cheaper to operate than a
football team, but both athletes receive all the equipment, they need.
Compliance is based on what is offered, not budgets.  It is a lot cheaper
to recruit women's basketball players than men's, less competition.  But
both coaches get all the recruiting money they need.  That is what the
Office of Civil rights is looking for.  So, if your varsity women's hockey
team receives less money then the men's doesn't mean you are out of
compliance.  If the women have to buy there own equipment then you probably
are.
