You really only have to worry about the NCAA licensing issue when you
include the NCAA logo, refer to the NCAA in the text on the merchandise
(like "1990 NCAA Division III Champions"), etc.)
 
The NCAA seems to handle it a couple of different ways: (1) awarding the
license for merchandise to a specific company ... so, if you want a sweatshirt
from a specific tournament, you buy it from a neutral third party (like
K-Mart or Penney's) who have contracted with a sportswear printing
company; (2) you can purchase the merchandise at the tournament (in the
case of the Division III hockey tournament, the NCAA provides pretty ugly
stuff to the host school through its contract vendor ... the host school
sells the merchandise and gets a percentage of the sales); or (3) if your
school is victorious and you want to sell merchandise telling the world
how great your team is, you pay the NCAA a licensing fee.
 
The logo licensing fees aren't restricted just to private universities
... you can't print T-shirts with Bucky Badger or Stevie Pointer without
paying a royalty fee ... and UW-Madison and UW-Stevens Point are both
public institutions.  What may vary are the royalty percentages.
